Informatie over AG tijdens het No Border Kamp/ Information About Legal Team during the Noborder Camp

Er is kans dat je opgepakt wordt als je demonstreert of op een andere manier actie voert voor je idealen. Daarom is er deze week ook een arrestantengroep (AG) beschikbaar om mensen die gearresteerd zijn (en eventueel langer vastgehouden kunnen worden) ondersteuning te bieden.

Op de Legal pagina van nobordercamps.eu vind je alvast de belangrijkste informatie vooraf, lees het goed zodat je juridisch goed voorbereid bent.
Mocht je dringende vragen hebben voor of tijdens het kamp dan kun je ons ook bereiken via de mail: arrestantengroep(@)riseup.net, of ons aanspreken als we voor vragen op het kamp aanwezig zijn.

We hebben advocaten gevraagd om bijstand te verlenen na een arrestatie. Voor strafrecht: Willem Jebbink, Jebbink en Soeteman advocaten Amsterdam. Voor vreemdelingenrecht: Martijn Strooij, Hamerslag en Van Haren advocaten Amsterdam.

Algemene belangrijke punten:
1. Ga je ergens aan meedoen waarbij er een redelijke kans is dat je wordt gearresteerd dan is het handig om dit van tevoren te vertellen aan iemand die je vertrouwt. Diegene kan dan contact opnemen met de arrestantengroep, doorgeven wie je advocaat is, je afmelden (ziekmelden?) bij school of werk, voor de planten en de poes zorgen enz. Bij het invullen van een briefje vooraf aan de actie kun je de naam en contactgegevens van die persoon ook doorgeven aan de AG, dan kunnen wij contact opnemen met hen.
2. Je hebt het recht om je naam NIET te noemen, wat de politie ook zegt.
3. VERKLAAR NOOIT IETS OVER JEZELF OF OVER ANDEREN!! Ze zitten niet met je te praten voor een goed gesprek tussen gelijkwaardige mensen, maar om informatie te ontfutselen over jou en over anderen. Hoe meer je vertelt, hoe groter de kans op veroordeling en straf. Vraag waarom je gearresteerd bent, vraag om je advocaat en zeg verder niets. De politie is erop getraind om op sluwe wijze informatie uit je te krijgen, ga hier nooit in mee. Het is de taak van de politie om je veroordeeld te krijgen, dus zoveel mogelijk bewijzen tegen je te verzamelen. De politie heeft geen andere taak dan dat. Wens je toch je principieel te verantwoorden voor de actie, dan is de (enige) plek daarvoor de rechtszaal waar je een slotwoord hebt.
4. De politie is verplicht je te vertellen waarvoor je bent gearresteerd.
5. Je hebt het recht om je eigen advocaat te zien, maar daar moet je wel zelf om vragen!
6. Vraag je advocaat altijd om zijn/haar kaartje!!!
7. Je hebt recht op je eigen dieet en wanneer nodig medische hulp. Eis dit. De politie zal hier namelijk erg moeilijk over kunnen doen, vooral als je anoniem blijft. Wees solidair en ondersteun elkaar in het eisen van dit soort dingen. Samen sta je sterk!
8. Vrouwen mogen alleen door vrouwelijke agenten worden gefouilleerd, mannen alleen door mannen.
9. Trans*personen worden gefouilleerd door een agent van het sekse dat in je paspoort staat. Als je anoniem blijft, zal de politie bepalen welk sekse zij jou toeschrijven.
10. Je hebt recht op een tolk bij het verhoor als je niet goed Nederlands spreekt. De politie moet dit voor je regelen. Vraag altijd een tolk voor je eigen taal.
11. De politie zal het niet zo nauw met de regels nemen, en zal je verblijf heel onaangenaam kunnen maken. De politie zal regels verschillend toe kunnen passen bij verschillende mensen. Probeer je hier van te voren mentaal op voor te bereiden.
12. Zij zullen zich niet altijd aan de regels houden. Ook zullen ze van alles uit de kast trekken om jou aan het praten te krijgen. Bereid je hier zo goed mogelijk op voor. Laat je niet intimideren, blijf kalm en bedenk: je hulp komt eraan!

Important general points:
1. If you are going to participate in something where there is a reasonable that you are going to be arrested, it is useful to let somebody that you trust know in advance. That person can then contact the AG, pass on who your lawyer is, call off or call in sick to work or school, take care of your plants and cat etc. When filling in a form before an action you can pass the name and contact details of this contact person on to the AG, so that we can then contact them for you.
2. You have the right NOT to give your name, no matter what the police say.
3. NEVER PROVIDE ANY INFORMATION ABOUT YOURSELF OR OTHERS!!! The police are not there to have a good conversation between equals with you, but to try and extract information about you and others. The more you say, the greater the odds of being convicted and penalised. Ask why you have been arrested, ask for your lawyer and say nothing else. The police are trained to get information out of you in sly ways, so never follow them in this. It is the task of the police to get you convicted, and therefore to gather as much evidence against you as possible. The police have no other task than that. If you want to justify the principles of the action, the place and time for that is the court room during peroration.
4. The police is obliged to tell you the reason for your arrest
5. You have the right to see your own lawyer, but you have to ask for them!
6. Always ask your lawyer for their card!!!! This is to ensure that the person in front of you is actually your lawyer.
7. You have the right to food of your own diet and medical help when necessary. Demand this. The police will be difficult in this, especially if you remain anonymous. Support each other in demanding these kinds of things. Together you stand strong!
8. Women are only allowed to be frisked by female officers, men only by male officers.
9. Trans*people will be frisked by someone of the gender that is noted in your passport. If you remain anonymous, the police assign someone of the gender that they think you are.
10. You have the right to a translator during questioning if you do not speak Dutch (well). The police must arrange one for you. Always ask for a translator from your own language.
11. The police will not play precisely by the rules and will make your stay unpleasant. The police will apply rules differently to different people. Try to prepare yourself for this mentally.
12. The police will not always stick to the rules. They will also try all kinds of things to try and get you to talk. Try to prepare yourself for this the best you can. Do not be intimidated, stay calm and think: There are people coming to help you!
