Vrijspraak in Fight Repression zaak

Op 19 november 2016 kwamen zo’n 250 mensen op het Kerkplein samen om vanaf daar een demonstratie te lopen tegen de repressie die zich de afgelopen jaren uitbreidt tegen anarchisten en antifascisten in Den Haag en daarbuiten. Repressie zoals het constant verbieden van demonstraties en het in kaart brengen van antifascisten en anarchisten om vervolgens repressieve maatregelen te kunnen treffen. En ook deze demonstratie werd de kop ingedrukt met repressie en geweld vanuit de politie waarbij er 166 mensen werden gearresteerd.


Bijna twee jaar later besloot het Openbaar Ministerie om de 166 mensen die op het Kerkplein waren gearresteerd te vervolgen. De eerste 50 mensen kwamen afgelopen maand voor de rechter. Na twee volle dagen in de rechtbank deed de rechter op 3 december uitspraak. De eerste 50 mensen werden vrijgesproken. Gisteren (13-12-2018) liet het Openbaar Ministerie weten niet in hoger beroep te gaan en de rest van de 166 zaken te seponeren.

De rechtszaak
Tijdens de twee dagen durende rechtszaak kwamen een aantal dingen naar voren. De politie beëindigde de demonstratie op het Kerkplein omdat sommige mensen gezichtsbedekking droegen. In de rechtszaak bleek, zoals onze advocaten al stelde dat er geen beperking vanuit de burgemeester was opgelegd dat dit niet zou mogen.

De politie stelde in het dossier dat ze er vanuit gingen dat de beperking omtrent het dragen van gezichtsbedekking er was. Ook werd er door de politie gesteld dat de burgemeester opdracht had gegeven om de demonstratie te beëindigen, echter is uit het dossier niet op te maken wie die opdracht heeft gegeven. Waar de gronden voor arrestatie, repressie en het ontnemen van het demonstratierecht op neer komen is dat de politie op eigen houtje besloot dat de demonstratie hun niet aanstond en overging tot arrestaties en het gebruiken van geweld.

Repressie
Deze gebeurtenis past in het plaatje van de repressie waar de demonstratie juist tegen was gericht. De politie in Den Haag focust zich al jaren op een ziekelijke manier op anarchisten en antifascisten. Zo worden demonstraties zonder een beslissing van de burgemeester met geweld beëindig, worden anarchisten thuis geïntimideerd, worden er invallen gedaan door groepen agenten om kleine boetes te innen waarbij de deur er wordt uit gebeukt en er foto's van persoonlijke dingen worden genomen. Het lijstje gaat nog wel even door. Gebiedsverboden, toren hoge boetes, pogingen tot het werven van informanten en het opbouwen van een CTER dossier.

Deze zaak laat overduidelijk zien wat er zo vaak gebeurt in Den Haag. De politie gaat op eigen houtje te werk, mensen worden gearresteerd en later weer vrijgesproken of helemaal niet vervolgd. Het is natuurlijk fijn dat je dan geen boete hoeft te betalen, maar in praktijk, op straat, verandert er niks. De politie kan doen en laten wat ze willen. Hun maakt het niets uit of we een boete meer of minder krijgen. En als een arrestatie onterecht blijkt zijn er geen gevolgen voor agenten. Zo kunnen ze ons effectief van de straten weren. Daarom zijn wij ook niet verbaasd dat dit schouwspel van politie, rechters en de politiecel zich weer heeft herhaald.

Maar als ze denken dat ze onze strijd voor solidariteit en een radicaal andere wereld hiermee stoppen hebben zij het mis. Geen wapenstok, agent of gevangenis zal ons stoppen om de strijd voor werkelijke vrijheid te voeren. Laten we reflecteren op deze gebeurtenissen en oncontroleerbare strijdmethodes creëren.

Acquittal in Fight Repression case

On November 19th 2016, a group of 250 demonstrators joined at the Kerkplein to demonstrate against the growing repression against anarchists and antifascists in The Hague and further. Repression being the always prohibiting of demonstrations and the identifying of anarchists and antifascist to then take repressive measures against them. This demonstration has also been repressed with violence from the police and with the arrest of 166 people.

Now, almost two years later the public prosecutor decided to prosecute the 166 demonstrators that were arrested at the Kerkplein. De first 50 people had to show up in court last month. After two full days in court, the judge ruled on December 3rd and the first 50 people were acquitted. Yesterday (13/12/2018) the public prosecutor decided not to appeal and to dismiss the remaining cases.

The court case
During the court case that lasted two days, a few things became clear. The police ended the demonstration at the Kerkplein, because some people were wearing face covering. In court it became clear, as our lawyers had already put forward, that there was no restriction on face coverings imposed by the mayor.

The police claimed in their file, that they assumed there was a restriction imposed on face coverings. The police also claimed that the mayor had given the order to end the demonstration. However, it did not become clear from the files who exactly gave that order. What it basically comes down to, is that the police decided on their own with using violence, to arrest, repress and deny demonstration rights because the demonstration simply did not please them.

Repression
This occurrence fits the image of repression that the demonstration was aimed at. The police in The Hague has been targeting anarchists and antifascists in a sickening way. Demonstrations have been ended with violence, without orders from the mayor. Anarchists are being intimidated in their homes, with police raids, breaking of doors to collect for small fines and taking pictures of personal items. The list continues with restraining orders, sky-high fines, attempts to recruit informants and the building of CTER* files.

This case shows clearly what has been happening so often in The Hague. The police decides on their own, people get arrested and acquitted later on or not prosecuted at all. Of course it is nice not to have to pay a fine, but in reality, on the streets nothing is changing. The police can do whatever they want to. They don’t care about us getting a fine or not. And if an arrest turns out to be unjustly, there are no consequences for the police. This is how they can effectively keep us off the street. And this is why we are not surprised that this spectacle of the police, judges and the police cell has repeated itself.

However, if they think that our fight for solidarity and a radically different world will stop, they are wrong. Let it be clear that no baton, officer or prison will stop us to fight for true freedom. Let us reflect on these events and create uncontrollable methods to continue to fight.
